Amending the Appendix to Chapter 409 of the Legislative Code Pursuant to Section 17.07.1 of the Charter, and Section 409.20 of the Legislative Code to expand the Commercial Development District at 1 Leech Street to include 200 Grand Avenue.

WHEREAS, an application and supporting documentation, herein incorporated as exhibits 6-1 through 7 was submitted by Healthcare Hospitality II, OST requesting the expansion of the 1 Leech Street Commercial Development District to include 200 Grand Avenue; and
WHEREAS, after conducting a hearing and considering the application and a report from city planning herein incorporated as exhibit 1-1 - 1-3, the Planning Commission supported the expansion of the 1 Leech Street district through a resolution herein incorporated as exhibit 2-1; and
WHEREAS, the Ordinance creating the 1 Leech Street Commercial Development District was passed by Council on September 13, 2017 by Ordinance Number 17-37, herein incorporated as Exhibit 9; and
WHEREAS, on November 17, 2017, Resolution 17-758, herein incorporated as Exhibit 8-1 and 8-2, which corrected a scrivener’s error in the description of the district was passed by Council; and
WHEREAS, on December 24, 2019, Resolution 19-2073, herein incorporated as Exhibit 4-1 and 4-2 waiving the petition requirements for the expansion of the district and directing that a public hearing be held was passed by Council; and
WHEREAS, a public hearing before City Council was conducted on August 12, 2020, at which all interested parties were given an opportunity to be heard, the Council having considered all the facts and recommendations concerning the application; now therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
SECTION 1
That the 1 Leech Street Commercial Development District is expanded to include 200 Grand Avenue, as shown in Exhibit 3, which is attached to and incorporated by reference in this ordinance pursuant to §17.07.1 of the Saint Paul City Charter and § 409.20 of the Saint Paul Legislative Code. The legal description of the expanded portion of the 1 Leech Street Commercial Development District is attached herein as Exhibit 7. This district and its legal description shall appear in the Appendix to Chapter 409 of the Saint Paul Legislative Code.
SECTION 2
The Expanded 1 Leech Street Commercial Development District shall be limited to no more than one (1) total liquor license.
SECTION 3
This Ordinance shall take effect and be in force thirty (30) days following its passage, approval and publication.
