WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and

WHEREAS, §293.09 provides for the granting of variances from the sound level limitations contained in §293.07, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on the applicant, other persons or on the community; and

WHEREAS, Granite Inliner, LLC., represented by Daniel Banken, Area Manager, who has been designated as the responsible person on the application, has applied for eleven (11) sound level variances, at a requested sound level limit of 80 decibels (dBA) at 50 feet, for sewer construction work, with use of heavy trucks with internal generators and hydraulic pumps during the sewer lining projects beginning September 8, 2020 through October 9, 2020. The project proposes to allow elevated sound levels during two (2) overnight periods for sewer cleaning and inspection, and for sewer lining at each of the eleven sites, with a sewer liner curing process requiring 24 hours of continuous work. Applicant indicates the site set up to occur from 6:00 p.m. to 10:00 p.m., with use of equipment with back up alarms and handheld power tools.
