Authorizing the City to enter into a cooperative agreement with MnDOT regarding the 2020 Como Trail Project.
Body
WHEREAS, the City has a project to construct a trail, sidewalk and bikeway improvements along Como Avenue between Raymond and Hamline Avenue; and
WHEREAS, construction of the trail and retaining wall crosses State Trunk Highway Right of Way; and
WHEREAS, the cooperative agreement contains an indemnification clause in favor of MnDOT, which the Council finds appropriate in order to effectuate this Project; and
WHEREAS, the City will provide for maintenance of these improvements upon, along, and adjacent to Trunk Highway No. 51, as defined in said Agreement.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and the proper City Officials are hereby authorized and directed for and on behalf of the City to enter into MnDOT Agreement Number 1034547, a copy of which is before Council and is made a part hereof; and
BE IT FINALLY RESOLVED, that the Mayor and the proper City Officials are authorized to execute the Agreement and any amendments to the Agreement.
