Title

Approving a Limited Use Permit with the State of Minnesota Department of Transportation for a pedestrian and bicycle trail in the rights-of-way of Trunk Highway 5 and Interstate Highway 94 at Johnson Parkway.

 

Body

WHEREAS, the City of Saint Paul plans to construct, operate, and maintain a pedestrian and bicycle trail along Johnson Parkway between Burns Avenue and Phalen Boulevard; and

 

WHEREAS, a portion of the trail would be located within the rights-of-way of State of Minnesota Trunk Highway 5 (Minnehaha Avenue) as well as Interstate Highway 94; and

 

WHEREAS, the State of Minnesota, Department of Transportation requires a Limited Use Permit for the construction and utilization of the trail; and

 

WHEREAS, the limited use permit requires that the City indemnify the State from all claims for injury to or death of persons or loss of or damages to property occurring on the trail, or connected with the City's use and occupancy of the area, except when such injury, death, loss, or damage is caused solely by the negligence of State of Minnesota, and the Council finds that it is appropriate to enter into this agreement; now, therefore, be it

 

RESOLVED, that the Mayor and Council of the City of Saint Paul hereby approve said Limited Use Permit, and be it

 

FURTHER RESOLVED, that the proper City officials are authorized to execute the Limited Use Permit and any amendments to the Permit.
