Authorizing the Office of Financial Empowerment to enter into an agreement with VistaShare for the development of the Outcome Tracker tool to establish a user interface and account tracker for the CollegeBound College Savings Account Program.
Body
WHEREAS, the City of Saint Paul through the Office of Financial Empowerment (OFE) will develop and administer a college savings account program; and
WHEREAS, the Outcome Tracker will be used to view and manage online accounts for the college savings account program; and
WHEREAS, the VistaShare agreement requires that the City indemnify VistaShare; and
WHEREAS, the Saint Paul City Council finds that the Outcome Tracker Software tool is necessary to implement and advance the College Savings Account program, which will serve the youth population and foster stronger communities within the City, and has a legitimate public purpose; and
WHEREAS, the expenditure of public funds, which includes the promise of indemnification and defense, for such a purpose will enable the City to facilitate and monitor the account tracking of the college savings accounts; now, therefore, be it
RESOLVED, that the proper city officials are authorized to enter into an agreement with VistaShare, which requires the City to be responsible for its agents’ and employees’ negligent acts, omissions or willful misconduct that are within the scope of their duties and that: cause injury to persons or property, result in the breach in the security or confidentiality of City Data or that violate the intellectual property rights of any third party.
