Title

Approving a Cooperative Construction Agreement with the State of Minnesota Department of Transportation for a pedestrian trail in the right-of-way of Trunk Highway 52 at Plato Boulevard and Trunk Highway 952A at Robert Street South.

 

Body

WHEREAS, the City of Saint Paul (“City”) has approved plans to construct, operate and maintain, for pedestrian and bicycle use, the Robert Piram Regional Trail (the “Trail”), between Harriet Island in Saint Paul and Kaposia Landing in South Saint Paul. The Trail is designated by the City and the State as State Aid Project No. 164-090-014 and No. 062-640-006; and

 

WHEREAS, portions of the Trail would be located along Plato Boulevard within State of Minnesota Trunk Highway 52 (Lafayette Freeway) and Trunk Highway 952A (Robert Street South); and

 

WHEREAS, to authorize the construction of and routine maintenance of the Trail by the City upon, along, and adjacent to Trunk Highway No. 52 and No. 952A, the State of Minnesota, Department of Transportation (“MnDOT”) requires a Cooperative Construction Agreement. MnDOT Agreement No. 1034346 is attached hereto as Exhibit A; and

 

WHEREAS, as a requirement of the Construction Cooperative Agreement, MnDOT requires that the City agree to indemnify MnDOT; and

 

WHEREAS, the City Council finds that the construction of the Robert Piram Regional Trail has a legitimate public purpose in providing additional recreational opportunities to the public; and

 

WHEREAS, the expenditure of Public funds which includes the promise of indemnification and defense, will facilitate that public purpose; now, therefore, be it

 

RESOLVED, that Council of the City of Saint Paul hereby authorizes the Mayor, Director of Finance, Director of Parks and Recreation, and City Attorney to execute MnDOT Agreement No. 1034346 with the State of Minnesota, Department of Transportation, and any amendments thereto.
