Approving a waiver of the 45-day notice requirement to issue Malt On Sale (Strong) and Wine On Sale licenses with conditions to Firebox Company LLC, d/b/a Firebox (License ID #20190002618) at 1585 Marshall Avenue.

WHEREAS, Firebox Company LLC d/b/a Firebox (License ID #20190002618) applied for a Malt On Sale (Strong) and Wine On Sale License for the premises located at 1585 Marshall Avenue; and
WHEREAS, the licensee requested a waiver of the 45-day notification waiting period for approval of the above-mentioned licenses; and
WHEREAS, the Department of Safety and Inspections received a letter from the Union Park District Council on September 10, 2019 in support of a waiver of the 45-day notice requirement and approval of the Malt On Sale (Strong) and Wine On Sale Licenses; and
WHEREAS, the Department of Safety and Inspections received no objections to the waiver of the 45-day notice requirement and approval of the Malt On Sale (Strong) and Wine On Sale Licenses; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of a waiver of the 45-day notice requirement and approval of the licenses; now, therefore, be it,
RESOLVED, a waiver of the 45-day notice requirement is granted and a Malt On Sale (Strong) and Wine On Sale License are hereby approved and issued to Firebox Company LLC d/b/a Firebox (License ID #20190002618) for the premises located at 1585 Marshall Avenue in Saint Paul with the following conditions:
CONDITION #1 PER ZONING VARIANCE #18-118951:
1. A decorative fence with a minimum height of forty-two (42) inches shall be installed along the south property line per Section 63.314(b) of the Zoning Code and the approved site plan.
ADDITIONAL LICENSE CONDITIONS 2 - 6:
2. Per City of Saint Paul Legislative Code 409.15(a)(2), On-sale wine license shall mean a license authorizing the sale of wine not exceeding fourteen (14) percent alcohol by volume, for consumption on the licensed premises only in conjunction with the sale and service of food (menu item only). The sale of Malt (Strong) will also take place only in conjunction with the sale and service of food.
3. Per City of Saint Paul Legislative Code 409.15(e), licensee must be able to show that gross receipts are at least sixty (60) percent attributable to the sale of food.
4. Licensee will submit to the Department of Safety and Inspections (DSI) annual gross receipts for food and liquor for each year the license is renewed.
5. No liquor sales, service, display and/or consumption is allowed outdoors without prior written approval and additional licensing from DSI.
6. Site improvements shall be completed by 03/06/2020 in accordance with the approved site plan on file with DSI dated 03/06/2019 and maintained in good order and repair thereafter.
