Approving adverse action against the Liquor Off Sale License held by Plankton Holding Inc, d/b/a The Liquor Vault (License ID #0130000044) at 170 East 10th Street.

WHEREAS, the Liquor Off Sale license held by Plankton Holding Inc d/b/a The Liquor Vault (License ID #0130000044) for the premises located at 170 E. 10th Street in Saint Paul, was the subject of a Notice of Violation dated August 14, 2019, stating an employee of the licensee sold alcohol to an underage person on July 31, 2019, in violation of Minn. Stat. § 340A.503, Subd. 2 (1) and Saint Paul Legislative Code § 409.08 (2) (a); and
WHEREAS, per Saint Paul Legislative Code § 409.26 (b) (3), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $500.00 matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a public or administrative hearing by August 28, 2019, that the matter would be placed on the next consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Plankton Holding Inc d/b/a The Liquor Vault (License ID #0130000044) for the premises located at 170 E. 10th Street in Saint Paul is hereby ordered to pay a $500.00 matrix penalty for the sale of alcohol to an underage person on July 31, 2019
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
