WHEREAS, the Cigarette/Tobacco license held by Northern Retail LLC d/b/a Speedway #4430 (License ID #20100004268) for the premises located at 846 Johnson Parkway in Saint Paul, was the subject of a Notice of Violation dated August 1, 2019, stating an employee of the licensee sold Marlboro cigarettes to an underage person on June 20, 2019, in violation of Minn. Stat. § 609.685 and Saint Paul Legislative Code § 324.07 (g) and (d); and
WHEREAS, per Saint Paul Legislative Code § 324.11(b) (1), the licensing office recommended a $200.00 matrix penalty; and
WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $200.00 matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $200.00 matrix penalty or request a public or administrative hearing by August 14, 2019, that the matter would be placed on the next consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Northern Retail LLC d/b/a Speedway #4430 (License ID #20100004268) for the premises located at 846 Johnson Parkway in Saint Paul is hereby ordered to pay a $200.00 matrix penalty for the sale of tobacco products to an underage person on June 20, 2019
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
