Approving adverse action against the Cigarette/Tobacco License held by Northern Tier Retail LLC, d/b/a Speedway #4038 (License ID #20100004245) at 390 Maryland Avenue.

WHEREAS, the Cigarette/Tobacco license held by Northern Tier Retail LLC d/b/a Speedway #4038 (License ID #20100004245) at 390 Maryland Avenue in Saint Paul was the subject of a Notice of Violation sent July 5, 2019; and
WHEREAS, the Notice stated that during a Cigarette/tobacco and price compliance check on April 16, 2019, a DSI Inspector observed Optimo Sweet Cigars- Blue Vanilla in violation of Saint Paul Legislative Code § 324.07 (f); and
WHEREAS, per Saint Paul Legislative Code § 310.05 (m) (2), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, the licensee did respond to the Notice of Violation to discuss the four (4) options available to them but failed to follow-up to either pay the $500.00 matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a public or administrative hearing by July 19, 2019, that the matter would be placed on the next available consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Northern Tier Retail LLC d/b/a Speedway #4038 (License ID #20100004245) for the premises located at 390 Maryland Avenue is hereby ordered to pay a $500.00 matrix penalty for the Optimo Sweet Cigars- Blue Vanilla.
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
