Approving the release of sewer easement rights for an abandoned sewer in a portion of vacated Bidwell Street and the northwesterly corner of Block 187, Robertson's Addition to West Saint Paul (property at 84 Water Street West).

WHEREAS, as part of the improvement of the sanitary sewer system in Water Street West, an older sewer located in the northwesterly corner of Block 187, Robertson's Additon to West Saint Paul, and vacated Bidwell Street between Water Street and Fillmore Avenue, as depicted in Exhibit A attached hereto, was abandoned; and
WHEREAS, Vacation Resolution CF 6399, approved June 19, 1902, and Vacation Resolution CF 242988, approved April 3, 1969, did not release the easement rights to said abandoned sewer; and
WHEREAS, the owner of 84 Water Street West, which property includes parts of said abandoned sewer, is now requesting the release of the easement rights to said abandoned sewer; now, therefore be it
RESOLVED, that with the Certificate of Intended Non-Use, filed voluntarily on behalf the City of Saint Paul's Department of Public Works; the City hereby waives all rights to said abandoned sewer; and be it further
RESOLVED, that said property owner shall either remove said abandoned sewer pipe or accept the Gopher State One Call (GSOC) locating obligations; and be it further
RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee from the property owner, the proper city officials are hereby authorized and directed to record a copy of said resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificate of Intended Non-Use referenced in this resolution.
