Approving the Liquor Outdoor Service Area (Patio) license with conditions for NH Enterprises LLC, d/b/a Beaningful Coffee (License ID #20180003942) at 370 Wabasha Street.

Body

WHEREAS, NH Enterprises LLC d/b/a Beaningful Coffee (License ID #20180003942) applied for a Liquor-Outdoor Service Area (Patio) license for the premises located at 370 Wabasha Street; and

 

WHEREAS, the licensee currently holds Wine On Sale and Malt On Sale (Strong) license; and

 

WHEREAS, the premises is located downtown so a petition is not required; and

 

WHEREAS, the Department of Safety and Inspections received no objections to the issuance of the Liquor-Outdoor Service Area (Patio) license; and

 

WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the Liquor Outdoor Service Area (Patio) license; now, therefore, be it,

 

RESOLVED, the Liquor Outdoor Service Area (Patio) licenses are hereby granted to NH Enterprises LLC d/b/a Beaningful Coffee (License ID #20180003942) for the premises located at 370 Wabasha Street in Saint Paul with the following conditions:

1. Per City of Saint Paul Legislative Code 409.15(a)(2), On-sale wine license shall mean a license authorizing the sale of wine not exceeding fourteen (14) percent alcohol by volume, for consumption on the licensed premises only in conjunction with the sale and service of food (menu item only). The sale of Malt (Strong) will also take place only in conjunction with the sale and service of food.

 

2.  Per City of Saint Paul Legislative Code 409.15(e), licensee must be able to show that gross receipts are at least sixty (60) percent attributable to the sale of food.

 

 

3.  Licensee will submit to the Department of Safety and Inspections (DSI) annual gross receipts for food and liquor for each year the license is renewed.

 

 

4.  Licensee agrees to take appropriate action(s) to ensure that the sale, display, and/or consumption of alcoholic beverages (i.e., wine/beer) is contained within the defined indoor and outdoor liquor service areas as per the approved service area plan on file with DSI.  And, acknowledges they are responsible for all activities conducted within this service area.

 

 

5.  Licensee shall secure all alcoholic beverages (i.e., wine/beer) in a manner to make them inaccessible at all times the establishment is closed.
