Stated Reason for Appeal (if given): This is the third time I've filled out this form.  I dispute the assessment for the following reasons:  1) the only information I received was that if I did not want to change the size of my garbage bin, I need do nothing.  My previous bin was small; I received a small and a medium bin.  I called the City and Republic several times over four months without satisfaction.  Had I received 2 small bins, I would not be disputing this charge.  I never used the medium bin.  I have one tenant, and I live alone.  One small bin was and is all we need.  Also, on principal, I dispute this charge:  there was no citizen input on the rollout of this change; several local garbage haulers were put out of business because of the poor implementation of this change; homeowners have been disrespected in that we were not trusted to determine our own needs in this matter.  I fully support citywide garbage hauling.  I do not support how it was done and the fallout all that entails.

 

Staff Comments: The previous hauler reported that there was a small garbage cart at this property, so one of the units was assigned the small weekly 35-gallon garbage cart. There was no cart size reported for the other unit, so it was assigned the medium 64-gallon garbage cart. There were no cart size changes during the first quarter of the program (October - December 2018). The City sent out the annual garbage and recycling guide in January 2019. There was information included in this guide that informed residents that they could begin contacting their garbage hauler directly to request a free cart size change. The property owner had the opportunity to change her cart size, but did not take the action to do so. The property owner is responsible for paying this bill because Republic Services provided garbage collection down this street during Quarter 1 2019 (January - March).

 

Body

WHEREAS, the Office of Financial Services Real Estate Section has attached to this Council File both a report of completion outlining the costs and fees associated with Collection of Delinquent Garbage Bills for services during January to March 2019. (File No. CG1902A1, Assessment No. 190101) and the assessment roll including all properties for which these assessments are proposed for Council ratification; and

 

WHEREAS, the City Council’s Legislative Hearing Officer has reviewed an appeal of this assessment and developed a recommendation for the City Council with respect to this assessment; and

 

WHEREAS, a public hearing having been conducted for the above improvement, and said assessment having been further considered by the Council and having been considered financially satisfactory; Now, Therefore, Be It

 

RESOLVED, that pursuant to Chapter 14 of the Saint Paul City Charter, said assessment is hereby ratified and reduced from $105.68 to $60.83 and payable in one installment.
