Authorizing the grant of an Environmental Covenant and Easement for CHS Field, 360 Broadway Street, to the MPCA and Ramsey County.
Body
WHEREAS, the City of Saint Paul ("City") constructed a new facility on city-owned park land known as CHS Field and legally described in Exhibit "A," a copy of which is attached and incorporated herein by this reference; and
WHEREAS, CHS Field is the location of releases or threatened releases of hazardous substances, or pollutants or contaminants that are addressed by an environmental response project under the MPCA Voluntary Investigation and Cleanup (“VIC”) Program, pursuant to Minn. Stat. § 115B.17, subd. 14. and the MPCA has determined that an Environmental Covenant is needed for the Property because impacted soil, groundwater, and soil vapors remain at the site; and
WHEREAS, as a condition of the grant received and in order to comply with the Uniform Environmental Covenants Act, Minn. Stat. ch. 114E (“UECA”), the City is required to grant an easement to allow MPCA and Ramsey County to enter the Property to inspect and to evaluate compliance with the Activity and Use Limitations, and to allow the MPCA to take samples of environmental media such as soil, ground water, surface water, and air, and to install, maintain and close borings, probes, wells or other structures necessary to carry out the sampling; and
WHEREAS, the Environmental Covenant must be recorded; now, therefore, be it
RESOLVED, that the Saint Paul City Council hereby authorizes the proper city officials to sign the Enviornmental Covenant and easement, a copy of which is attached hereto and to record it with Ramsey County Property Records and Revenue Department.
