Ratifying the assessment for the 2018 Street Maintenance Service Program-Mill and Overlay: Franklin Avenue from TH 280 to Pelham. (File No. MO1812, Assessment No. 185509) (Public hearing held August 21)

Body
WHEREAS, Street Maintenance Service Program-Mill and Overlay services are authorized for assessment under Minnesota Statute § 429.101 and Laws of Minnesota 1967 Chapter 442; and
WHEREAS, assessment for the costs of such services are further authorized by Saint Paul Legislative Code Chapter 62; and
WHEREAS, on April 3, 2019 the City Council adopted RES PH 19-37 ratifying the assessment for the 2018 Street Maintenance Service Program-Mill and Overlay: Franklin Avenue project and including Cromwell from Franklin to University (File No. MO1801, Assessment No. 185500); and
WHEREAS, on June 19, 2019 the City Council adopted RES 19-775 to withdraw its ratification of said assessment and direct the Office of Financial Services Real Estate Section to prepare a new assessment to reflect modified assessment amounts for the 2018 Mill and Overlay projects; and
WHEREAS, the City Council in RES 19-1087 accepted the Report of Completion for the new assessment of benefits, costs and expenses for the 2018 Street Maintenance Service Program-Mill and Overlay: Franklin Avenue from TH 280 to Pelham; and
WHEREAS, the City Council held a public hearing on August 21, 2019 to consider ratification of the assessment roll; and
WHEREAS, the City Council considered and found satisfactory the assessment of benefits, costs and expenses for the 2018 Street Maintenance Service Program-Mill and Overlay: Franklin Avenue from TH 280 to Pelham; now, therefore be it
RESOLVED, that the said assessment is hereby in all respects ratified; and be it further
RESOLVED, that the Council of the City of Saint Paul, exercising its power under the authority of Minnesota Statute § 429.101 and following the procedures in Minnesota Statutes Chapter 429, hereby ratifies the assessments in all respects;...
