Approving a waiver of the 45-day notice requirement to issue Malt On Sale (Strong) and Wine On Sale licenses with conditions to The Waters Senior Living Management LLC, d/b/a The Waters Of Highland Park (License ID #20190001068) at 678 Snelling Avenue.

WHEREAS, The Waters Senior Living Management LLC d/b/a The Waters Of Highland Park (License ID #20190001068) applied for a Malt On Sale (Strong) and Wine On Sale license for the premises located at 678 Snelling Avenue; and
WHEREAS, the licensee requested a waiver of the 45-day notification waiting period for approval of the above-mentioned licenses; and
WHEREAS, the Department of Safety and Inspections received a letter from the Highland District Council on May 2, 2019 in support of a waiver of the 45-day notice requirement and approval of the Malt On Sale (Strong) and Wine On Sale licenses; and
WHEREAS, the Department of Safety and Inspections received no objections to the waiver of the 45-day notice requirement and approval of the Malt On Sale (Strong) and Wine On Sale licenses; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of a waiver of the 45-day notice requirement and approval of the licenses; now, therefore, be it,
RESOLVED, a waiver of the 45-day notice requirement is granted and the Malt On Sale (Strong) and Wine On Sale licenses are hereby approved and issued to The Waters Senior Living Management LLC d/b/a The Waters Of Highland Park (License ID #20190001068) for the premises located at 678 Snelling Avenue in Saint Paul.
with the following conditions:
1. The licensee shall take appropriate steps to ensure that the operation of the business covered under the Wine On Sale and Malt On Sale (Strong) licenses is limited to serving only residents of The Waters of Highland Park complex and their designated guests.
2. Licensee shall take appropriate steps to ensure that the sale, display, and/or consumption of alcoholic beverages (i.e., wine and beer) is restricted to the seating areas shown on the plan on file with the Department of Safety and Inspections (DSI).
3. No liquor sales and/or service is allowed outdoors without prior written approval and additional licensing from DSI.
4. Licensee agrees to operate in a manner that complies with applicable State, Federal, and Local rules and regulations for the service of wine and malt beverages, including those found under Section 409.15 of the City of Saint Paul Legislative Code.
