WHEREAS, the Liquor on Sale-101-180 seats or less, Liquor on sale-Sunday, Entertainment (A) licenses held by Twin City Beer Barons d/b/a World of Beer (License ID #20140003000) for the premises located 356 Sibley Street were the subject of a Notice of Intent to Suspend Licenses dated April 15, 2019, stating the licensee submitted a Certificate of Liability insurance indicating a Thirty-three (33) days lapse in liquor liability coverage in violation of Saint Paul Legislative Code Section 409.065; and


WHEREAS, pursuant to Saint Paul Legislative Code Section 409.26 (b) (12) the licensing department recommended a Ten (10) day suspension of all licenses; and


WHEREAS, the licensee did not respond to the Notice of Intent to Suspend Licenses to request a public or administrative hearing; and


WHEREAS, the Notice of Intent to Suspend Licenses stated that if the licensee failed to, request a public or administrative hearing by April 25, 2019, that the matter would be placed on the May 15, 2019 Council consent agenda to impose the recommended penalty;


WHEREAS, the matter was placed on the May 15, 2019 Council consent agenda and on May 15, 2019 Council passed RES 19-795 which imposed the ten (10) day suspension and set June 5, 2019 as the date that the suspension was to begin; and


WHEREAS, on May 31, 2019 the City Attorney’s Office received correspondence which included notification that Twin City Beer Barons was under a bankruptcy related automatic stay imposed under United States Bankruptcy Court Case 8:19-bk-04377-CPM; and


WHEREAS, the City Attorney’s Office requested and received proof of current liquor liability insurance; and


WHEREAS, an agreement was reached to stay the ten (10) day suspensio...
