Amending RES PH 19-159 by retaining an easement for Xcel Energy.
Body
WHEREAS, upon the petition of Bremer Bank and Snelling Shields LLC ("Petitioner"), as documented in Real Estate Vacation File Number 02-2019, the public property described in resolution RES PH 19-159 was vacated by the Saint Paul City Council on June 5th, 2019, a copy of which is attached hereto; and
WHEREAS, a utility easement was intended to be retained by Xcel Energy as one of the conditions to vacate the public property referenced in said RES PH 19-159; so, therefore be it
RESOLVED, that RES PH 19-159 be amended to add the following condition:
9. An easement shall be retained over, under and across the vacated property on behalf of Xcel Energy to service its facilities abutting the vacated property; and be it
FURTHER RESOLVED, that all other terms and conditions of said RES PH 19-159 shall remain in full force and effect.
