Authorizing the appointment of LeVander, Gillen & Miller, PA as outside counsel and authorizing the appropriate City officials to enter into an agreement.
Body
WHEREAS, Saint Paul City Charter § 5.02 permits the City, upon recommendation of the City Attorney and in the case of special or unusual circumstances, to appoint outside counsel to represent the City; and
WHEREAS, the City Council previously appointed Kennedy and Graven as outside counsel for the Midway stadium relocation benefit litigation with Peter Mikhail as the principal attorney pursuant to RES 18-923; and
WHEREAS, Peter Mikhail has left Kennedy and Graven to join the firm of Levander, Gillen & Miller, P.A. and the City Attorney recommends that the litigation remain with the primary attorney and therefore that LeVander, Gillen & Miller, P.A be appointed outside counsel; now, therefore, be it
RESOLVED, that the appropriate city officials are hereby authorized to enter into the attached agreement with Levander, Gillen & Miller, P.A. represent the City in litigation related to relocation eligibility and benefits under the Minnesota Uniform Relocation Act.
