WHEREAS, the Tow Truck Wrecker (Operator) and Tow Truck Wrecker (Vehicle) license applications submitted by Absolute Towing & Recovery, Inc. d/b/a Absolute Towing (License ID# 20190000202) for the City of Saint Paul were the subject of a Notice of Intent to Deny Licenses (“Notice”) dated February 21, 2019; and
WHEREAS, the Notice stated on February 13, 2019, a DSI Inspector followed up on a complaint received that the applicant was operating without a license at 83 Arlington Avenue, 66-65 West Hyacinth Avenue and 41 Arlington Avenue West in Saint Paul; and
WHEREAS, when the inspector arrived at each of the above-mentioned addresses he observed and documented with photographs signs posted that show the applicant as the entity responsible for towing unauthorized vehicles; and
WHEREAS, towing vehicles without the appropriate license(s) is in violation of Saint Paul Legislative Code § 361.02; and
WHEREAS, per Saint Paul Legislative Code § 310.06 (b)(6)(a) and (c), the licensing office recommended denial of the licenses; and
WHEREAS, an attorney representing the applicant responded to the Notice of Intent to Suspend Licenses on March 4, 2019 to request a public hearing which is scheduled on April 17, 2019; now therefore be it
RESOLVED, the Tow Truck Wrecker (Operator) and Tow Truck Wrecker (Vehicle) license applications submitted by Absolute Towing & Recovery, Inc. d/b/a Absolute Towing (License ID# 20190000202) for the City of Saint Paul are hereby denied.
