Authorizing the Mayor's Office and the Department of Public Works to enter into and sign a host site agreement(s) with the MPCA to host 3 AmeriCorps members from the Minnesota GreenCorps, a program of the Minnesota Pollution Control Agency, for the 2019-2020 program year.

Body
WHEREAS, The Mayor’s Office and Public Works have applied to host 3 AmeriCorps members from the Minnesota GreenCorps, a program of the Minnesota Pollution Control Agency (MPCA), for the 2019-2020 program year, including a position in the Mayor’s Office focused on assisting with Energize Saint Paul energy benchmarking efforts and electric vehicle carshare efforts, a position in Public Works Right of Way Management Division focused on vegetation management in the right-of-way, and a position in Public Works Transportation Planning focused on the City’s Safe Routes to Schools program; and

WHEREAS, if the MPCA selects the City of Saint Paul for one or more of these positions, the City of Saint Paul is committed to implementing the proposed project(s) as described in the host site applications, and in accordance with the pre-scoped position descriptions; and

WHEREAS, the MPCA requires that the City of Saint Paul enter into a host site agreement(s) with the MPCA that identifies the terms, conditions, roles and responsibilities; and

WHEREAS, one of the terms of the host site agreement is an indemnification clause which requires the City to “indemnify, save, and hold harmless the State, its agents, and employees, from any claims or causes of action, including attorney's fees incurred by the State, to the extent caused by the Host Site's: 1. Intentional, willfull, or negligent acts or omissions; 2. Actions that give rise to strict liability; 3. Breach of contract or warranty"; and

WHEREAS, the City Council finds that the promise of indemnification is appropriate in order for City to host 3 AmeriCorps members from the Minnesota GreenCorps; now, therefore, be it
