Requesting authorization to enter into a short-term lease agreement with Washington Prime Group for the City's use of a portion of the Maplewood Mall parking lot for the temporary relocation of vehicles stored at the Police Impound Lot due to the potential for flooding and the City's declared emergency.

 

Body

WHEREAS, the Saint Paul Police Department ("SPPD") Impound Lot is located at 830 Barge Channel Road, Saint Paul, Minnesota ("Impound Lot Property"); and

 

WHEREAS, the Impound Lot Property is situated in the Mississippi River flood plain and the river is forecasted to continue rising within the next several days and/or weeks, resulting in the City of Saint Paul's declared emergency and the potential flooding of the Impound Lot Property and vehicles stored on it; and

 

WHEREAS, the SPPD desires to relocate approximately 700 vehicles currently stored at the Impound Lot Property prior to a flood event and has negotiated a lease agreement (the "Lease") with Washington Prime Group ("Lessor") that manages the Maplewood Mall, Maplewood, Minnesota; and

 

WHEREAS, key provisions of the Lease include a one-month lease term, a $5,000 per month lease rate, and an indemnification by the City of Sain Paul for any claims, losses, liabilities, damages, penalties, fines and expenses in connection with the SPPD's use of the leased premises; now,

 

THEREFORE, BE IT RESOLVED, that the City Council hereby authorizes the proper city officials to enter into said Lease with Lessor, and to further negotiate and execute any lease renewals or extensions that may be required as flood conditions warrant.
