Accepting a public sidewalk and city street light easement from the State of Minnesota for a widened and realigned sidewalk and new street lighting along the west side of Cedar Street within the State Capitol Grounds property.

WHEREAS, in 2017 the City of Saint Paul ("City") approved a site plan for the State of Minnesota's ("State") capitol renovation project that included the installation of two vehicle bump-in lanes along the west side of Cedar Street south of University Avenue, and the widening and realignment of the existing public sidewalk and installation of city street light fixtures on capitol grounds property owned by the State; and
WHEREAS, a requirement of the site plan process was the State's conveyance to the City of a Public Sidewalk and City Street Light Easement (the "Easement") for the sidewalk and lighing improvements on capitol grounds property; and
WHEREAS, the Easement includes an indemnification whereby the City and State each is responsible for its own acts, with the State's liability governed by the provisions of state law and the City's liability limited by the provisions of Minnesota Statutes Chapter 466 and other applicable law (Section 7); now, therefore, be it
RESOLVED, that the City Council does hereby accept the Easement from the State, attached hereto as Exhibit A, and authorizes and directs the proper city officials to execute and record the Easement with the Ramsey County Registrar and/or Recorder’s Office.
