WHEREAS, the Cigarette/Tobacco license application submitted by Khaled Zeid Ghneim for Stryker Market, LLC d/b/a Stryker Market (License ID#20180002288) for the premises located at 605 Stryker Avenue in Saint Paul was the subject of a Notice of Intent to Deny License sent December 3, 2018; and

WHEREAS, Ahmad Al-Hawwari, manager of Stryker Marker applied for a Cigarette/Tobacco license on September 14, 2016 and was sent a Notice of Intent to Deny License on January 12, 2017; and

WHEREAS, the Notice of Intent to Deny License was sent to Ahmad Al-Hawwari based on numerous violations related to the license activity in Minneapolis within the previous five (5) years which made him ineligible for a license pursuant to Saint Paul Legislative Code § 324.01 (d) (2) (a) and (b); and

WHEREAS, State of Minnesota records show that Stryker Market, LLC is currently managed by Ahmad Al-Hawwari who the Department of Safety and Inspections believes is an interested party under the definition of Saint Paul Legislative Code § 310.02 (e) and therefore the current license application must be treated as an application by the person whose license was denied or revoked; and

WHEREAS, based on that information, the licensing department recommended denial of the Cigarette/Tobacco license; and

WHEREAS, the applicant failed to respond to the Notice of Intent to Deny License to request a public or administrative hearing or withdraw the license application; and

WHEREAS, the Notice of Intent to Deny License stated that if the applicant failed to request a public hearing, administrative hearing or withdraw the license application by December 10, 2018, that the matter would be placed on the January 2, 2019 Council Consent Agenda to impose the recommended penalty; now, therefore, be it
