Authorizing the City to enter into an Agreement with Ramsey County for a Temporary Encroachment Permit and Access Permit to facilitate work by the County and the City along Kellogg Boulevard.
Body
WHEREAS, the City of Saint Paul and Ramsey County wish to enter into a temporary encroachment and access permit to allow the County to enter the City right of way and sidewalk along Kellogg Boulevard to its real property generally located at 12, 14 and 50 West Kellogg Boulevard to install certain improvements and for the City to have access to the County Property for the purpose of inspecting the roadway and related improvements; and
WHEREAS, the Permit requires that each party defend and indemnify the other party as a result of any claims, costs, demands, damages, liabilities or expenses resulting from their activities under the Permit; and
WHEREAS, the Saint Paul City Council finds that the reason for the temporary encroachment and access permit is to facilitate necessary work by the County and the City; and
WHEREAS, the expenditure of public funds, which includes the promise of indemnification and defense, will enable the work to be performed and has a public purpose; now, therefore, be it
RESOLVED, that the City Council authorizes the appropriate city officials to enter into the attached agreement with Ramsey County, which contains an indemnification clause.
