Approving the application with conditions, per the Deputy Legislative Hearing Officer, for Gazta and Enhancements (License # 20180002846), LLC, d/b/a Gazta & Enhancements, for Liquor On Sale - 100 seats or less, and Liquor On Sale - Sunday licenses at 928 7th Street West, #106.

Body
WHEREAS, Gazta and Enhancements (License # 20180002846), LLC, d/b/a Gazta & Enhancements, applied for Liquor On Sale - 100 seats or less, and Liquor On Sale - Sunday licenses; and

WHEREAS, the licensee received support from the West 7th/Fort Road Federation to waive the 45-day notification; and

WHEREAS, per RES 18-1461, the City Council granted approval on September 5, 2018 for Liquor On Sale - 100 seats or less, and Liquor On Sale - Sunday licenses with the following conditions:

1. All sales, display and/or consumption of alcohol under this license shall remain within the licensed service area, which is the separately defined indoor seating area and kitchen space supporting this use that shall be compact and contiguous with each other, as shown on the approved floorplan submitted with the license application and on file with the Department of Safety and Inspections (DSI).
2. Licensee shall maintain an approved barrier that physically separates and defines the licensed service area to ensure the sale, display and/or consumption of alcohol remains within the approved area.
3. Licensee agrees to close the establishment at 12:00 a.m. midnight each day of the week. All patron/customers shall vacate the premises by 12:30 a.m. each day of the week as per City Zoning Code (parking requirement); and

WHEREAS, objections to the Liquor On Sale - 100 seats or less, and Liquor On Sale - Sunday licenses were received within the notification period, and a hearing was held on October 15, 2018; and

WHEREAS, after conducting the hearing and considering the testimony, the Deputy Legislative Hearing Officer recommends that the application for Liquor On Sale - 100 seats or less, and Liquo...
