Approving the release of easement rights retained in the vacated alley in the block known as Warner's Prospect Park Addition to St. Paul.

Body
WHEREAS, St. Paul Leased Housing Associates X, LLLP ("Owner"), owns or has interest in the property located in the block known as Warner's Prospect Park Addition to St. Paul (aka Block 1, Moorhouse Commons); and

WHEREAS, Owner and/or its assigns plan to develop the vacated alley, along with other properties, into a multi-unit apartment development, and have engaged in the City's site plan review process; and

WHEREAS, when said alley was vacated by City Council No. 114428, on April 13, 1939 ("Vacation Resolution"), a copy of which is attached hereto, the utility easements were retained under condition (1); and

WHEREAS, in order for the planned development to proceed, the retained easements must be released; and

WHEREAS, Owner and/or its assigns have requested the release of the retained easements; now, therefore be it

RESOLVED, that with the Certificates of Intended Non-Use, filed voluntarily on behalf of the City of St. Paul, Department of Public Works, Xcel Energy, St. Paul Regional Water Services, Qwest Corporation dba CenturyLink QC, Verizon aka MCI and Comcast, the City of Saint Paul, for itself and on behalf of said public and private utilities, hereby waives, releases and terminates the easement rights retained in the Vacation Resolution; and be it further

RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, the proper city officials are hereby authorized and directed to record a copy of this resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificates of Intended Non-Use referenced in this resolution; and be it finally
