Title

Authorizing permanent and temporary easements and parkland diversion to the Minnesota Department of Transportation within the Oxford Community Center property.

 

Body

WHEREAS, the City of Saint Paul ("City”) is owner of park property in Saint Paul located at 270 Lexington Parkway North, known as Oxford Community Center ("Park Parcel"); and

 

WHEREAS, the Minnesota Department of Transportation (“MnDOT”) is requesting that the City grant permanent and temporary easements over a portion of the Park Parcel to construct ADA compliant sidewalks, as depicted and described in the attached Exhibit A; and

 

WHEREAS, the grant of easement within the Park Parcel constitutes a diversion of parkland in accordance with Section 13.01.1 of the City Charter; and

 

WHEREAS, MnDOT has requested the diversion of parkland within the Park Parcel and has agreed to pay just compensation as determined by an independent appraisal pursuant to Section 13.01.1 of the Saint Paul City Charter; and

     

WHEREAS, the Saint Paul Parks and Recreation Commission recommends the diversion of parkland, as stated in its Resolution #18-14 adopted August 16, 2018 and as shown in Exhibit B; now, therefore be it

     

RESOLVED, that the proper city officials are hereby authorized and directed to grant permanent and temporary easements to MnDOT for the use of the Park Parcel and to accept just compensation from MnDOT for deposit into the Parkland Replacement Fund, which is to be held in reserve for future purchase of park property as required in Chapter 13.01.1 of the City Charter; and to be fully compensated by MnDOT for all fees required by the City to comply with its parkland diversion guidelines.
