Approving the release of a slope easement at 75 Como Avenue for Oye Como Va LLC.



WHEREAS, the City of Saint Paul ("City") received a request from legal counsel for Oye Como Va LLC ("Owner") for the release of a slope easement encumbering Owner's property located at 75 Como Avenue, Saint Paul, said property described as Lots 9, 10, 11 and 12, Block 14, Brewster's Addition to St. Paul, Ramsey County, Minnesota, and identified as Parcel ID No. 31-29-22-23-0011 (the "Property"); and


WHEREAS, said slope easement was granted to the City in 1904 for use in connection with grading of adjoining Capitol Boulevard, formerly Brewster Avenue, as set forth in the instrument recorded in Book L of Plans, page 20, Ramsey County Recorder's Office, attached hereto as Exhibit A; and


WHEREAS, the City's Department of Public Works ("Public Works") has determined that the City's slope easement rights over the Property are no longer necessary and may be waived, released and terminated; now, therefore, be it


RESOLVED, that with the Certificate of Intended Non-Use, signed voluntarily on behalf of the City by Public Works, the City hereby waives, releases and terminates said slope easement rights; and be it further


RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee from Owner, the proper city officials are hereby authorized to record a certified copy of this resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the City's Office of Financial Services Real Estate Section shall maintain on file a copy of the signed Certificate of Intended Non-Use referenced in this resolution.
