WHEREAS, the Auto Repair Garage and Motor Vehicle Salvage Dealer licenses held by Corp Auto, Inc. d/b/a Corp Auto, Inc. (License ID# 20030002015) for the premises located at 1221 Pierce Butler Route were the subject of a Notice of Violation - Notice of Intent to Suspend Licenses dated September 25, 2018, 2018; and

WHEREAS, the Notice stated that during an inspection of the licensed premises on August 8, 2018, an inspector from the Department of Safety and Inspections (DSI) observed and documented with photographs six (6) license condition violations; and

WHEREAS, this was the third (3rd) violation within the past eighteen (18) months; and

WHEREAS, pursuant to Saint Paul Legislative Code ยง 310.05 (m) (1), the licensing office recommended a $2,000.00 matrix penalty and a ten (10) day suspension of the Auto Repair Garage and Motor Vehicle Salvage Dealer licenses; and

WHEREAS, the licensee responded to the Notice of Violation - Notice of Intent to Suspend Licenses to request a public hearing which was held on November 7, 2018; and

WHEREAS, the public hearing was rescheduled to December 19, 2018 due to a medical emergency of the licensee; and

WHEREAS, the public hearing was held on December 19, 2018 and the matter was laid over to January 9, 2019; and

WHEREAS, on January 9, 2019, Councilmember Jilali Nelson made a motion for a reduction in the matrix penalty from two thousand ($2,000.00) dollars to one thousand ($1,000.00) dollars and to stay the ten (10) day suspension; and

WHEREAS, Councilmember Jilali Nelson laid out the following reasons to support her motion:

1. The testimony given by the licensee at the public hearing stated that he believed he was meeting the requirements of the previous violation.
