Approving adverse action against the Wine On Sale and Malt On Sale (Strong) licenses held by Taste of Thailand Restaurant, Inc. d/b/a Taste of Thailand Restaurant at 1671 Selby Avenue.

WHEREAS, the Wine On Sale and Malt On Sale (Strong) licenses held by Taste of Thailand Restaurant, Inc. d/b/a Taste of Thailand Restaurant (License ID #0071341) for the premises located at 1671 Selby Avenue in Saint Paul were the subject of a Notice of Intent to Suspend Licenses dated October 1, 2018; and
WHEREAS, the Notice stated the licensee failed to pay delinquent license fees and submit the following information: 1) a completed State of Minnesota Renewal of Liquor, Wine of Club License form and 2) copies of their state sale and use tax statement for the previous twelve (12) months from the Department of Revenue for verification of gross food and beverage sales; and
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit information required to maintain the licenses; and
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend Licenses to pay the delinquent license fees and submit the required information; and
WHEREAS, the Notice of Intent to Suspend Licenses stated that if the licensee failed to pay the delinquent license fees and submit the required information, request a public hearing or cancel the licenses by October 11, 2018 that the matter would be placed on the October 24, 2018 City Council consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Wine On Sale and Malt On Sale (Strong) licenses held by Taste of Thailand Restaurant, Inc. d/b/a Taste of Thailand Restaurant (License ID #0071341) for the premises located at 1671 Selby Avenue are hereby suspended.
FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit required information to maintain the licenses. ...
