Approving adverse action against the Tree Trimmer & 1 Vehicle and Tree Trimmer - Each Additional Vehicle licenses held by Golden Oak Tree Service, Inc.

WHEREAS, the Tree Trimmer & 1 Vehicle and Tree Trimmer - Each Additional Vehicle licenses held by Golden Oak Tree Service, Inc. d/b/a Golden Oak Tree Service, Inc. (License ID #20170001729) for the City of Saint Paul were the subject of a Notice of Intent to Suspend Licenses dated October 1, 2018; and
WHEREAS, the Notice stated the licensee failed to submit current Minnesota Department of Transportation (MN DOT) Inspection reports for three (3) vehicles to be re-licensed and payment of $68.00 in late fees; and
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit information required to maintain the licenses; and
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend Licenses to submit the required MN DOT inspection report and $68.00 in late fees, request a public hearing or cancel the licenses; and
WHEREAS, the Notice of Intent to Suspend Licenses stated that if the licensee failed to submit required MN DOT inspection reports and $68.00 in late fees, request a public hearing or cancel the licenses by October 11, 2018 that the matter would be placed on the October 24, 2018 City Council consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Tree Trimmer & 1 Vehicle and Tree Trimmer - Each Additional Vehicle licenses held by Golden Oak Tree Service, Inc. d/b/a Golden Oak Tree Service, Inc. (License ID #20170001729) for the City of Saint Paul are hereby suspended.
FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit the required MN DOT inspection reports and $68.00 in late fees.
FINALLY RESOLVED, the licenses will remain suspended until required MN DOT inspection reports on vehicles to be re-licensed...
