Approving adverse action against the Tree Trimmer & 1 Vehicle and Tree Trimmer - Each Additional Vehicle licenses held by Bratt Tree Company, Inc.

WHEREAS, the Tree Trimmer & 1 Vehicle and Tree Trimmer - Each Additional Vehicle licenses held by Bratt Tree Company, Inc. d/b/a Bratt Tree Company, Inc. (License ID #0070281) for the City of Saint Paul were the subject of a Notice of Intent to Suspend Licenses dated September 12, 2018; and
WHEREAS, the Notice stated the licensee failed to submit current Minnesota Department of Transportation (MN DOT) Inspection reports for three (3) vehicles licensed and provide vehicle information and obtain inspection approvals for two (2) new vehicles licensed; and
WHEREAS, per Saint Paul Legislative Code §310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit information required to maintain the licenses; and
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend Licenses to submit the required MN DOT inspection information and provide vehicle information and obtain inspection approvals for two (2) new vehicles licensed, request a public hearing or cancel the licenses; and
WHEREAS, the Notice of Intent to Suspend Licenses stated that if the licensee failed to submit required MN DOT inspection information and provide vehicle information and obtain inspection approvals for two (2) new vehicles licensed, request a public hearing or cancel the licenses by September 24, 2018 that the matter would be placed on the October 10, 2018 City Council consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Tree Trimmer & 1 Vehicle and Tree Trimmer - Each Additional Vehicle licenses held by Bratt Tree Company, Inc. d/b/a Bratt Tree Company, Inc. (License ID #0070281) for the City of Saint Paul are hereby suspended.
FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit the required MN DOT inspection information and provide vehicle information and obtain inspection approvals for two (2) new vehicles licensed.
FINALLY RESOLVED, the licenses will remain suspended until all required MN DOT inspection information on current vehicles is submitted, new vehicle information is provided and all inspection approvals are completed.
