Pertaining to a Fifteenth Rider to Agreement with the Ramsey County Board of Commissioners to allow surface grade modifications at the southeast shoreline of Black Tern Pond.

WHEREAS, an Agreement between the Board of County Commissioners of Ramsey County (“County”) and the Board of Water Commissioners of the City of Saint Paul (“Board”) dated June 6, 1966 provided permission for the County to enter upon Board property to carry out necessary operations in respect of certain County improvements; and
WHEREAS, Board is owner of land located along the southeasterly shoreline of Black Tern Pond in the South half of the SW quarter of Section 31, Township 30 North, Range 22 West, Ramsey County, Minnesota (the “Premises”); and
WHEREAS, the County desires at this time permission to enter upon the Premises and to thereupon perform surface grade modifications to mitigate floodplain fill required by Ramsey County Project P-3382, the reconstruction of the Interstate 694 interchange at Rice Street; and
WHEREAS, the Board is willing to grant said permission, consistent with the requirements and safety of the works of the Board; and
WHEREAS, staff has prepared a Fifteenth Rider to Agreement which grants permission for said activities, and which protects the Board’s rights, interests and facilities, and the assistant city attorney has approved it as to form; now, therefore, be it
RESOLVED, that the Board of Water Commissioners of the City of Saint Paul does hereby approve the Fifteenth Rider to Agreement with the Board of Commissioners of Ramsey County in substantially the form submitted, and that the proper officers are hereby directed and authorized to execute said Rider on behalf of the Board following approval of the assistant city attorney.
