Approving of a waiver of the 45-day notification requirement and three-hundred (300) foot separation distance requirement from a protected use in order to issue a Liquor Off Sale and a Cigarette/Tobacco license to The Applebaum Companies, Inc., d/b/a Big Top Liquors (License ID #20180002156) at 1544 University Avenue West.

WHEREAS, The Applebaum Companies, Inc. d/b/a Big Top Liquors (License ID #20180002156) located at 1544 University Avenue West requested a waiver of the 45-day notification requirement and three-hundred (300) foot separation distance requirement from a protected use as outlined in Saint Paul Legislative Code § 409.06 (i) (3) in order to issue a Liquor Off Sale and Cigarette/Tobacco license; and
WHEREAS, a notice was sent to all residential property owners within three hundred (300) feet of the licensed premises and no objection was received; and
WHEREAS, the licensee was able to obtain seven (7) of nine (9) possible signatures from nearby residential properties for seventy-eight percent (78%) support; and
WHEREAS, the Department of Safety and Inspections received a letter from the Union Park District Council in support of waiving the 45-day notification requirement and three-hundred (300) foot separation distance requirement in order to issue the licenses; and
WHEREAS, the Council finds that the application is in order and there are no grounds to deny either the waivers or the licenses; now therefore be it
RESOLVED, the 45-day notice requirement and three-hundred (300) foot separation distance requirement from a protected use as outlined in § 409.06 (i) (3) of the Saint Paul Legislative Code are hereby waived and a Liquor Off Sale and Cigarette/Tobacco are hereby granted The Applebaum Companies, Inc. d/b/a Big Top Liquors (License ID #20180002156) for the premises located at 1544 University Avenue West in Saint Paul.
