Title

Approving the addition of Liquor-Outdoor Service Area (Sidewalk) and Entertainment (B) licenses to the existing Liquor On Sale -100 Seats or less and Liquor On Sale-Sunday licenses for Premier Management, LLC, d/b/a La Costa Mexican Sports Bar & Grill (License ID #20160000962) at 194 Cesar Chavez Street.

Body

WHEREAS, Premier Management, LLC d/b/a La Costa Mexican Sports Bar & Grill (License ID #20160000962) applied for a Liquor-Outdoor Service Area (Sidewalk) and an Entertainment (B) license for the premises located at 194 Cesar Chavez Street; and 

WHEREAS, the licensee currently holds a Liquor On Sale -100 Seats or less, a Liquor On Sale-Sunday and an Entertainment (A) license; and

WHEREAS the licensee submitted a “good faith” letter indicating she was able to get twenty-one (21) additional petition signatures which shows generally favorable support in the neighborhood to add the Liquor-Outdoor Service Area (Sidewalk) and Entertainment (B) licenses at that location; and

WHEREAS, the licensee obtained a total of twenty-four (24) of out a possible forty-nine (49) required petition signatures for fifty-one percent (51%) support to add the Liquor-Outdoor Service Area (Sidewalk) and Entertainment (B) licenses; and

WHEREAS, the Department of Safety and Inspections received a letter from the West Side Community Organization in support of adding a Liquor-Outdoor Service Area (Sidewalk) and an Entertainment (B) license; and

WHEREAS, the Department of Safety and Inspections received no other objections to the issuance of the licenses; and

WHEREAS, the Council finds that the applications are in order and there are no grounds for denial of a Liquor-Outdoor Service Area (Sidewalk) and an Entertainment (B) license now, therefore, be it,

RESOLVED, a Liquor-Outdoor Service Area (Sidewalk) and an Entertainment (B) license are hereby granted to Premier Management, LLC d/b/a La Costa Mexican Sports Bar & Grill (License ID #20160000962) for the premises located at 194 Cesar Chavez Street in Saint Paul with the following conditions:

1.   Licensee agrees to operate the establishment in compliance with Section 409.02 of the City of Saint Paul Legislative Code as a "Restaurant".

2.  Licensee agrees to close the establishment at 12:00 a.m. midnight. All patron/customers shall vacate the premises by 12:30 a.m. each day of the week as per City Zoning Code (parking requirement) and Section 409.02 of the City of Saint Paul Legislative Code.

3.  Licensee agrees to limit the placement of table(s)/chair(s) on the public sidewalk to the area and number shown on the approved sidewalk seating plan on file with the Department of Safety and Inspections (DSI) and Public Works.  Licensee shall take appropriate action to ensure table(s)/chair(s) are contained to this approved area.

4.  Each year prior to the placement of table(s) and/or chair(s) in the public right-of-way (i.e., sidewalk), the licensee agrees to obtain a new Obstruction Permit from the Department of Public Works.  Licensee agrees to maintain the sidewalk café in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective on April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be placed in the public right-of-way before or after the effective/expiration dates, and that a failure to comply with this condition will result in adverse action being taken against all of their licenses.

5.  Licensee agrees to take appropriate action(s) to ensure that the sale, display, and/or consumption of alcoholic beverages is contained within the defined area as per the approved liquor service area on file with DSI.

6.  Any activities related to the outdoor seating area and/or providing of entertainment shall comply with applicable State and Local rules and regulations, including but not limited to Chapter 293 Noise Regulations of the City of Saint Paul Legislative Code.
