Approving adverse action against the Cigarette/Tobacco license held by Family Dollar, Inc., d/b/a Family Dollar Store (License ID #20030004635) at 1536 University Avenue West.

 

Body

WHEREAS, the Cigarette/Tobacco license held by Family Dollar, Inc. d/b/a Family Dollar Store (License ID #20030004635) for the premises located at 1536 University Avenue West in Saint Paul was the subject of a Notice of Violation sent June 29, 2018; and 

 

WHEREAS, the Notice stated that during a menthol education and compliance check on April 27, 2018, a DSI Inspector observed 2-pack cigars priced incorrectly in violation of Saint Paul Legislative Code § 324.07 (e); and

 

WHEREAS, per Saint Paul Legislative Code § 310.05 (m) (2), the licensing office recommended a $500.00 matrix penalty; and

 

WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $500.00 matrix penalty or request a public or administrative hearing; and

 

WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a public or administrative hearing by July 9, 2018, that the matter would be placed on the July 25, 2018 consent agenda to impose the recommended penalty; now, therefore, be it

 

RESOLVED, Family Dollar, Inc. d/b/a Family Dollar Store (License ID #20030004635) for the premises located at 1536 University Avenue West is hereby ordered to pay a $500.00 matrix penalty for the incorrect pricing of 2-pack cigars. 

 

Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
