Title
Approving the application with conditions, per the Deputy Legislative Hearing Officer, for French Meadow on Grand LLC (License # 20130001546), d/b/a French Meadow Bakery and Café, to increase the Sunday through Thursday outdoor patio seating closing time from 9:30 p.m. to 10:00 p.m. at 1662 Grand Avenue.

WHEREAS, a request has been made by French Meadow on Grand LLC (License # 20130001546), d/b/a French Meadow Bakery and Café, to modify condition #8 relating to the outdoor patio seating closing time from Sunday through Thursday from 9:30 p.m. to 10:00 p.m. to be consistent with nearby eating establishments; and

WHEREAS, an objection was received during the notification period limiting the outdoor patio area to 10:30 p.m., and

WHEREAS, the Executive Director of the Macalester-Groveland Community Council submitted a letter supporting "uniformity of hours among businesses on this block"; and

WHEREAS, French Meadow Bakery and Café has been in business since 2014 and, in that time, no enforcement actions have been taken against the licensed establishment; and

WHEREAS, the Deputy Legislative Hearing Officer finds that French Meadow Bakery and Café's request will not adversely affect nearby residents and that condtion #8 would be consistent with other eating establishments that have similar hours of operation and similar operational conditions, and

WHEREAS, the Deputy Legislative Hearing Officer recommends that the application for French Meadow on Grand LLC (License # 20130001546), d/b/a French Meadow Bakery and Café, to increase the Sunday through Thursday outdoor patio seating closing time from 9:30 p.m. to 10:00 p.m. be approved with the following conditions:

1. Licensee agrees to operate the establishment in compliance with Section 409.02 of the City of Saint Paul Legislative Code as a "Restaurant".
2. Licensee agrees to close the establishment at 12:00 a.m. midnight. All patron/customers shall vacate the premises by 12:30 a.m. each day of the ...
