Approving the Contract for Water Service agreement with the City of Mendota.

WHEREAS, the Board of Water Commissioners of the City of Saint Paul (the “Board”) and the City of Mendota (“Mendota”) did enter into an agreement on June 13, 1994 (the “1994 Agreement”) which provided for retail water service to the residents of Mendota; and
WHEREAS, the 1994 Agreement had expired on June 12, 2014; and
WHEREAS, the Board has continued retail water service to the residents of Mendota without interruption and without formal contract since that time; and
WHEREAS, the parties desire to execute a new contract that would formalize the continuance of retail water service to the residents of Mendota; and
WHEREAS, staff of the parties have negotiated an agreement that addresses such desires, along with other pertinent subjects pertaining to maintenance and operation of Mendota’s water system by the Board (“Contract for Water Service”); and
WHEREAS, Saint Paul Legislative Code Section 85.04 requires the adoption of a resolution by the Council of the City of Saint Paul authorizing such cooperative agreements; and
WHEREAS, the Board did adopt Resolution No. 18-770 which approved the Contract for Water Service and which requested that the Honorable Council of the City of Saint Paul authorize said Contract for Water Service; now, therefore, be it
RESOLVED, that the Contract for Water Service between the Board of Water Commissioners of the City of Saint Paul and the City of Mendota pertaining to maintenance and operation of Mendota’s water system is hereby approved, and that the proper officers are hereby directed to execute said Contract for Water Service on behalf of the City of Saint Paul.
