Approving a waiver of the 45-day notification requirement to issue a Liquor Outdoor Service Area (Patio) license with conditions to HBCL, LLC, d/b/a Hodges Bend (License ID #20170004483) at 2700 University Avenue West, Ste. 100.

WHEREAS, HBCL, LLC d/b/a Hodges Bend (License ID #20170004483) applied for a Liquor Outdoor Service Area (Patio) license for the premises located at 2700 University Avenue West, Ste. 100; and
WHEREAS, the licensee also requested a waiver of a 45-day notification requirement for approval of the above-mentioned license; and
WHEREAS, the licensee currently holds a Liquor On Sale 101-180 Seats and Liquor On Sale-Sunday license; and
WHEREAS, the licensee submitted a “good faith” letter and was able to obtain eighty-nine (89) out of a possible one hundred forty-four (144) signatures for sixty-two percent (62%) support of a Liquor-Outdoor Service Area (Patio) license; and
WHEREAS, the Department of Safety and Inspections received a letter from St. Anthony Park Community Council in support of a waiver of the 45-day notification requirement and approval of a Liquor Outdoor Service Area (Patio) license; and
WHEREAS, the Department of Safety and Inspections received no objections to a waiver of the 45-day notification requirement and approval of a Liquor Outdoor Service Area (Patio) license; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of a waiver of the 45-day notification requirement and approval of a Liquor Outdoor Service Area (Patio) license; now, therefore, be it,
RESOLVED, a waiver of the 45-day notification requirement is granted and a Liquor Outdoor Service Area (Patio) license is hereby issued to HBCL, LLC d/b/a Hodges Bend (License ID #20170004483) for the premises located at 2700 University Avenue West, Ste. 100 in Saint Paul with the following conditions:
