Pertaining to a Release of Easement in the Weyerhaeuser Company's property east of Emerald Street and north of Vacated Myrtle Street in the City of Saint Paul.

WHEREAS, the Board of Water Commissioners of the City of Saint Paul (“Board”) staff has determined that the water system easement over the real property legally described below (“Property”) is not required for current or future maintenance, construction, improvement or operation of the Board’s water works system

Ramsey County, Minnesota
Torrens Property
; and
WHEREAS, the purchase of the property, St. Paul Leased Housing Associates IX, LLLP, has requested the Board release the water system easement imposed upon the Property by executing a release of easement document to be recorded by the Ramsey County Recorder’s office; and
WHEREAS, the water main in the easement will be relayed within rededicated right-of-way as part of the redevelopment; and
WHEREAS, the owners of the Property have prepared a Release of Easement which does release all easement rights possessed by the Board over the property; now, therefore, be it
RESOLVED, that the Board of Water Commissioners of the City of Saint Paul does hereby approve the Release of Easement which does release all rights imposed upon the above described Property possessed by the Board of Water Commissioners of the City of Saint Paul and that the proper officers are hereby authorized to execute said Release of Easement on behalf of the Board following approval from the assistant city attorney.
