Appeal of Ray Kaiser to a Re-Inspection Fire Certificate of Occupancy With Deficiencies at 613 PARKWAY DRIVE.

Purpose of Appeal:  Attached deficiency list findings are being appealled as the structure is compliant with attached legislative code 34.10(3) and 34.09(4) as highlighted.  SPLC 34.34(2) is not applicable to single family residentail as highlighted in attachements. Furthermore property is occupied by immediate family member (Mother) for no financial compensation and has no commercial activity.

Legislative Hearing Staff Comments:  Built in 1926. Question to owner of when and if staircase replaced.  Question called in to Steve Ubl about code in 1926 on topic of balustrades.

WHEREAS, in the matter of appeal of Ray Kaiser to a Re-Inspection Fire Certificate of Occupancy With Deficiencies at 613 PARKWAY DRIVE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council grant the the appeal allowing for the alternative method of compliance as outlined in the attached proposal from the owner; Now, Therefore, Be It

 

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
