Approving a waiver of the 45-day notice requirement to issue a Liquor-Outdoor Service Area (Patio) license with conditions to Stone Saloon SBC, d/b/a Waldmann (License ID #20170000652) at 445 Smith Avenue North.

WHEREAS, Stone Saloon SBC d/b/a Waldmann (License ID #20170000652) applied for a Liquor-Outdoor Service Area (Patio) license for the premises located at 445 Smith Avenue North in Saint Paul; and
WHEREAS, the licensee currently holds a Liquor On Sale-Sunday, a Malt Off Sale (Growler), a Malt On Sale (Brewery Taproom) and an Entertainment (A) license; and
WHEREAS, the licensee was able to obtain twenty-eight (28) thirty (30) out of fifty (50) possible petition signatures for fifty-six percent (56%) sixty percent (60%) support of a Liquor-Outdoor Service Area (Patio) license; and
WHEREAS, the Department of Safety and Inspections received a letter from West 7th/Fort Road Federation in support of a waiver of the 45-day notice requirement and approval of a Liquor-Outdoor Service Area (Patio) license; and
WHEREAS, the Department of Safety and Inspections received no objections to the waiver of the 45-day notice requirement or approval of a Liquor-Outdoor Service Area (Patio) license; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the waiver of the 45-day notice requirement or approval of a Liquor-Outdoor Service Area (Patio) license now, therefore, be it,
RESOLVED, a waiver of the 45-day notice requirement is granted and a Liquor-Outdoor Service Area (Patio) license is hereby issued to Stone Saloon SBC d/b/a Waldmann (License ID #20170000652) for the premises located at 445 Smith Avenue North with the following conditions:
CONDITIONS #1 PER ZONING HISTORIC USE VARIANCE #15-143784:
1. Maintain the required 6 off-street parking spaces at all times (currently located at 444 W. 7th Street) and proof of the existence of the required parking must be provided to the city upon request.
