Rescinding Council Resolution RES 18-455 and its regulatory prohibitions.

WHEREAS, on March 14, 2018, the Council of the City of Saint Paul, under Council RES 18-455, initiated a legislative process to enact an interim ordinance pursuant to Minn. Stat. § 462.355, Subd. 4 in a manner consistent with the legislative procedure requirements of Saint Paul City Charter § 6.05; and
WHEREAS, this legislative process included the passage and approval on March 14, 2018 of RES 18-455 which contained certain regulatory prohibitions intended to effectively utilize those regulatory protections granted to municipalities under Minn. Stat. § 462.357, Subd. 4 pending the enactment of an interim ordinance in compliance with City Charter § 6.05’s legislative procedures; and
WHEREAS, accordingly, on March 14, 2018 under Council ORD 18-15, the Council also introduced for adoption pursuant to City Charter § 6.05, an interim ordinance pursuant to Minn. Stat. § 462.355, Subd. 4 pending a study and potential establishment of a Merriam Park Heritage Preservation District; and
WHEREAS, on April 11, 2018, following an April 4, 2018 public hearing on ORD 18-15, the Council duly moved to withdraw ORD 18-15 from consideration for final adoption and to rescind immediately the regulatory prohibitions of RES 18-455 and directed staff to prepare a resolution to that effect; NOW,
THEREFORE, BE IT RESOLVED, based upon the foregoing, Council RES 18-455 and its regulatory prohibitions have been and are rescinded as of the Council’s April 11, 2018 action.
