WHEREAS, on January 2, 2018 a Cigarette/Tobacco-Product Shop license application was submitted by New Hope Market, LLC d/b/a New Hope Market (License ID# 20170002877) for the premises located at 1132 Playne Avenue; and

WHEREAS, the Cigarette/Tobacco-Product Shop license application submitted by New Hope Market, LLC d/b/a New Hope Market (License ID# 20170002877) for the premises located at 1132 Payne Avenue in Saint Paul was the subject of a Notice of Intent to Deny License (“Notice”) dated March 2, 2018; and

WHEREAS, the Notice stated on January 4, 2018, the Department of Safety and Inspections received a Notice of Seized Contraband from the Minnesota Department of Revenue concerning contraband tobacco products seized from the licensed premises during an inspection on October 19, 2017; and

WHEREAS, the applicant failed to disclose on the new license application that there were contraband tobacco products seized from the premises on October 19, 2017; and

WHEREAS, based on that information, per Saint Paul Legislative Code § 310.06 (b) (1), the licensing department recommended denial of the license application; and

WHEREAS, on March 9, 2018, an attorney for the applicant responded to the Notice of Intent to Deny License requesting clarification of our ordinance; and

WHEREAS, there has been no further communications from either the attorney or the applicant; and

WHEREAS, the Notice of Intent to Deny License stated that if the applicant failed to request a public hearing, administrative hearing or withdraw the license application by March 12, 2018, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
