Approving adverse action against the Cigarette/Tobacco license held by Blue Store St Paul at 879 Fremont Avenue.

WHEREAS, the Cigarette/Tobacco license held by Blue Store St Paul d/b/a Blue Store St Paul (License ID #20090000478) for the premises located at 879 Fremont Avenue in Saint Paul, was the subject of a Notice of Intent to Suspend License dated February 21, 2018, stating the licensee failed to respond to a Notice of City Council Action sent from the Department of Safety and Inspections on January 26, 2018; and
WHEREAS, the Notice stated that following the public hearing on January 17, 2018, the licensee’s Cigarette/Tobacco license was suspended for ten (10) days from February 7, 2018 to February 16, 2018 and a $2,000.00 matrix penalty imposed by City Council (RES PH #18-17); and
WHEREAS, the penalty was imposed because a DSI Inspector found flavored hemp tobacco products displayed for sale during an inspection of the licensed premises on December 18, 2017 in violation of Saint Paul Legislative Code § 324.07(f); and
WHEREAS, the licensee was given until February 16, 2018 to pay the $2,000.00 matrix penalty; and
WHEREAS, the Notice of Intent to Suspend License for non-payment of a City Council imposed penalty was sent to the licensee on February 21, 2018; and
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend License to pay the $2,000.00 matrix penalty or request a public hearing; and
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay the $2,000.00 matrix penalty by March 1, 2018 that the matter would be placed on the next available consent agenda to impose the recommended penalty; now, therefore, be it
