Approving adverse action against the Malt Off-Sale license held by Wung Lee Thao, d/b/a Wung Lee Supermarket (License ID #20020006039) at 347 University Avenue West.

WHEREAS, the Malt Off-Sale license held by Wung Lee Thao d/b/a Wung Lee Supermarket (License ID #20020006039) for the premises located at 347 University Avenue West in Saint Paul was the subject of a Notice of Intent to Suspend License dated February 5, 2018, stating the licensee failed to pay delinquent license and late fees and submit required information to maintain the license; and
WHEREAS, per Saint Paul Legislative Code §310.05 (m) (2), the licensing office recommended a $500.00 matrix penalty for failure to submit required information to maintain the license; and
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend License to pay the delinquent license and late fees and submit required information, request a public hearing or cancel the license; and
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay the delinquent license and late fees and submit required information, request a public hearing or cancel the license by February 16, 2018, that the matter would be placed on the next available consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Malt Off-Sale license held by Wung Lee Thao d/b/a Wung Lee Supermarket for the premises located at 347 University Avenue West (License ID #20020006039) is hereby suspended.
FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit required information in order to maintain the licenses.
FINALLY RESOLVED, the license will remain suspended until delinquent license and late fees are paid in full and required information is submitted to the Department of Safety and Inspections.
