Approving adverse action against the Massage Center-B (Home Location) and Massage Practitioner licenses held by Kong Xiong, d/b/a Kay’s Massage at 917 Barclay Street. (To be withdrawn.)

WHEREAS, the Massage Center-B (Home Location) and Massage Practitioner licenses held by Kong Xiong d/b/a Kay’s Massage (License ID #20130003212) for the premises located at 917 Barclay Street in Saint Paul were the subject of a Notice of Intent to Suspend Licenses dated January 30, 2018; and
WHEREAS, the licensee failed to pay delinquent license and late fees and submit the following required information: 1) current certificates of General and Professional Liability insurance; 2) list of massage practitioners operating on site with license numbers and 3) a completed Certificate of Compliance Minnesota Workers’ Compensation Law form; and
WHEREAS, per Saint Paul Legislative Code §310.05 (m) (2), the licensing office recommended suspension of the licenses and a $500.00 matrix penalty for failure to submit required information to maintain the license; and
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend Licenses to pay the delinquent license and late fees and submit the required information, request a public hearing or cancel the licenses; and
WHEREAS, the Notice of Intent to Suspend Licenses stated that if the licensee failed to pay the delinquent license and late fees and submit the required information, request a public hearing or cancel the licenses by February 9, 2018, that the matter would be placed on the next available consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Massage Center-B (Home Location) and Massage Practitioner licenses held by Kong Xiong d/b/a Kay’s Massage (License ID #20130003212) for the premises located at 917 Barclay Street in Saint Paul are hereby suspended.
FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit required information in order to maintain the licenses.
FINALLY RESOLVED, the licenses will remain suspended until all delinquent license and late fees are paid in full and required information is submitted to the Department of Safety and Inspections.
