Making finding on the appealed nuisance abatement ordered for 947 BARCLAY STREET in Council File RLH RR 17-8.

WHEREAS, the City Council adopted RLH RR 17-8 on June 26, 2017 which granted an extension for 180 days to abate the nuisance conditions at 947 Barclay Street; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on January 16 and February 13, 2018 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were not abated but will grant continuation of the first $5,000 performance deposit. Owner needs to post a 2nd $5,000 performance deposit by February 23rd, noting that DSI will not issue a permit until the new deposit is received and provide an updated work plan, including new timelines, with update bids for the remaining repairs;

 

WHEREAS, on February 20, 2018 a second performance deposit was posted with the Department of Safety and Inspections and by March 1, 2018 revised work plans and contractor bids were accepted; and

 

WHEREAS, all required conditions have been met, the Legislative Hearing Officer recommends granting a stay of enforcement of Council File RLH RR 17-8 for 180 days; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is [abated and the matter resolved / are not abated and therefore authorizes the Department of Safety and Inspections to proceed with this nuisance abatement grants a 180-day stay of enforcement of Council File RLH RR 17-8 for the nuisance conditions to be abated.
