Pertaining to a Release of Easement upon private property in the city of West Saint Paul.

WHEREAS, portions of the property described below (“Property”) is subject to a perpetual easement held by the Board of Water Commissioners of the City of Saint Paul (the “Board”) to provide water to a private water main.
Property description:
Lot 1, Block 1, MORELAND COMMERCIAL CENTER, according to the recorded plat thereof, Dakota County, Minnesota
and
The North 86 feet of the South 175 feet of the East 110 feet of the East 5 acres of the North 2/3 of the West 953 feet of the North ½ of SW ¼ of SW ¼ of 17-28-22, and adjoining vacated street, Dakota County, Minnesota
and
The West 30’ of Livingston Avenue, now vacated, which accrued to the following described parcel upon the vacation thereof: The East 110’ of the South 175’ of the East 5 acres of the North 2/3 of the West 953’ of the North ½ of the Southwest ¼ of the Southwest ¼; Section 17, Township 28, Range 22, according to the U.S. Government Survey thereof, Dakota County, Minnesota.
and
WHEREAS, the Board has no need for an easement over this Property; and
WHEREAS, the Board was requested by the current owner of the Property to release all easement rights imposed upon the Property by executing a release of easement document to be recorded by the Dakota County Recorder’s office; and
WHEREAS, the owners of the Property have prepared a Release of Easement which does release all easement rights possessed by the Board over the Property; now, therefore, be it
RESOLVED, that the Board of Water Commissioners of the City of Saint Paul does hereby approve the Release of Easement which does release all rights imposed upon the above described Property possessed by the Board of Water Commissioners of the City of Saint Paul to supply a private water main, and that the proper officers are hereby authorized to execute said Release of Easement on behalf of the Board following approval from the assistant city atto...
